Well, it’s serious business. &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;Consumer advocates are saying the FDA is allowing too much inorganic arsenic into apple and grape juice and that the government is failing to enforce protective standards. The FDA allows 23 parts per billion as a benchmark to determine whether apple juice is contaminated. Consumers Union, publisher of Consumer Reports, is calling for this level to be reduced to as low as 3 parts per billion. Well, organic arsenic is not harmful to the body and will quickly pass through. It’s the inorganic arsenic that’s the problem. Inorganic arsenic is known to cause bladder, lung, and skin cancer as well as increase the risk of heart disease and type 2 diabetes. Some reports have even suggested that arsenic exposure can affect brain development in children!&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;So what should you do if you have a juice-drinking toddler? Osteoporosis is&amp;nbsp;a condition in which the bones become thin and weak and break easily. The FDA panel is expected to make recommendations on whether use of osteoporosis frugs should be limited to a few years or whether some women should temporarily stop treatment, a concept known as a drug holiday. It was originally thought that osteoporosis medications could be used indefinitely. However, problems began surfacing in the late 1990's that changed the outlook.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;&lt;strong&gt;Fosamax&lt;/strong&gt; (an oral bisphosphonate) is&amp;nbsp;probably the most common m&lt;/span&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;edication that has been prescribed to both men and women as a treatment and preventative for osteoporosis. It has also been prescribed to women and men who are taking corticosteroid medications. Most commonly, women take Fosamax during and after menopause.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;Fosamax is not the only drug in this class of oral bisphosphonates. The other more common names are &lt;strong&gt;Reclast, Boniva, Actonel, Zometa, Aredia, Didronel and Skelid.&amp;nbsp; &lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;However, in the 16 years since the FDA approved the&amp;nbsp;first oral bisphosphonate, which was Fosamax made by Merck &amp;amp; Co., they have all had numerous problems.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif; font-size: large;"&gt;Jaw Bone Danger&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;The Journal of Oral and Maxillofacial Surgeons reported a link between bisphosphonates and a serious bone disease called Osteonecrosis of the Jaw (ONJ). ONJ is a disfiguring and disabling condition of the jaw bone that causes infection and rotting of the jaw bone. Typical presentation of Osteonecrosis is pain, soft-tissue swelling and infection, loosening of teeth, drainage, and exposed bone. Symptoms may occur spontaneously, or at the site of previous tooth extraction. Some cases require the complete removal of the affected jaw bone.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;The FDA and the manufacturer of Fosamax issued a warning to health care professionals on September 24, 2004 of the danger of ONJ associated with the use of this drug.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif; font-size: large;"&gt;Thigh Bone Danger&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;Unfortunately, Fosamax and other bisphosphonates (which include &lt;strong&gt;Reclast, Boniva, Actonel, Zometa, Aredia, Didronel and Skelid&lt;/strong&gt;) did not only cause problems with jaw bones. However, children under the age of 8 who weigh more than 40 pounds and are more than 4 feet 9 inches tall will be exempted from the law. Children who are less than 40 pounds and shorter than 57 inches tall are just too small to properly be restrained by a vehicle's seatbelt alone. They will be required to use a booster seat or 5-point harness.&lt;br /&gt;&lt;br /&gt;Statistics show that only about 12% of children between the ages of 6 and 8 are currently using booster seats so there will be a lot of children going back into booster seats that had previously been using only the vehicle's lap and shoulder belt. But the bright side is this: statistics also show that children who are properly restrained have a much greater chance of surviving a motor vehicle collision with minor injuries or no injuries at all.&lt;br /&gt;&lt;br /&gt;While children may reach the age where all they are required to use is a booster seat, experts agree that car seats with a 5-point harness are the best protection for children less than 100 pounds. The reason is this simple:&amp;nbsp;the 5-point harness system is designed to distribute the forces of a car crash across the strongest bones of a child's body--the shoulders, chestbone and thigh bones--and minimize the strain placed on the child's neck and spine. This dosage level can increase the risk for myopathy, which is a form of muscle damage.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;Simvastatin is sold under the brand name Zocor, in addition to being sold as a generic product. It is also sold in combination with other drugs under the brand names Vytorin and Simcor. &lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;The FDA recommendation is that doctors only continue prescribing the 80 mg dose to patients who have been taking it for at least a year without experiencing problems. &lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;Additionally, simvastatin should not be taken with some other drugs, including some antibiotics, HIV drugs and anti-fungal medications, according to the FDA and Merck, which makes the drug.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;In 2010, about 2.1 million patients in the United States were prescribed a product containing simvastatin at that dose, the agency said. The product is commonly used for pain associated with teething, canker sores, and irritation of the mouth and gums. &lt;?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;The FDA became concerned about products containing benzocaine because they may cause a rare but serious and possibly fatal condition where oxygen in the blood stream is greatly reduced. This condition is called methemoglobinemia. In the most serious cases, this condition can result in death. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;Benzocaine products do not currently carry any warnings regarding methemoglobinemia, therefore, the FDA is concerned that consumers might not be aware of the danger or know what to look for when using these products. Signs and symptoms of methemoglobinemia include pale, gray or blue colored skin, lips and nail beds, shortness of breath, fatigue, confusion, headache, lightheadedness, and rapid heart rate. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family:trebuchet ms;"&gt;&lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;p style="MARGIN: 0in 0in 0pt" class="MsoNormal"&gt;&lt;span style="font-family:trebuchet ms;"&gt;The FDA is particularly concerned about the use of benzocaine products in children under two years of age. There have been 21 reported cases of methemoglobinemia after using benzocaine gels and liquids. The lack or improper use of car seats is a significant contributor to this sobering statistic. According to the &lt;a href="http://www.nhtsa.dot.gov/"&gt;National Highway Traffic Safety Administration&lt;/a&gt; (NHTSA), more than 40% of children under 6 who die or suffer debilitating injuries in automobile accidents are unrestrained or improperly restrained; however, when car seats are used correctly they are 71% effective in preventing injury among infants and 54% effective with children ages 1-4.&lt;br /&gt;&lt;br /&gt;Unfortunately, there is a lot of confusion concerning the proper restraining methods and what is required by Georgia law.&lt;br /&gt;&lt;br /&gt;According to Georgia law (&lt;a href="http://www.lexis-nexis.com/hottopics/gacode/default.asp"&gt;O.C.G.A. § 40-8-76.1&lt;/a&gt;):&lt;br /&gt;&lt;br /&gt;•ALL children under the age of six, regardless of how tall they are, must ride in the backseat of a car. A child is safer in the back and farthest away from the force of an airbag. Remember that airbags are designed to save adults, and since they deploy with great force they can be fatal to children.&lt;br /&gt;&lt;br /&gt;•Children under the age of six are required to be in either a car seat or a booster seat suitable for their age and height.&lt;br /&gt;&lt;br /&gt;•If there is not a back seat in the vehicle (e.g., a truck) or if other restrained children are in the back seat, Georgia law permits a child under the age of six to sit in front if restrained in the proper car seat or booster.&lt;br /&gt;&lt;br /&gt;NHTSA recommends the following as a guideline for child seat safety. A 5 point harness is comprised of straps or webbing that extend over your child’s hips, shoulders/collar bones, and between their legs. These types of safety restraints more evenly distribute the force during impact which could save your child’s life in a crash. The majority of parents believe that their child’s car seat is properly installed, but research by the National Highway Traffic Safety Administration shows that 8 out of 10 car seats are installed incorrectly.&lt;br /&gt;&lt;br /&gt;As a guide, when a car seat is properly installed one should not be able to move the car seat more than one inch in any direction. The seatbelt should be threaded through the car seat and completely latched. The shoulder strap should be pulled all the way out until it clicks and then should be fed back into column. This will ensure that the car seat does not fly forward in the event of an emergency stop or accident. One such type of failure is that the implant does not properly adhere to the bone and becomes unattached. Another such failure is that over time metal particles slough off and the debris causes inflammation, tissue damage and extreme pain to an individual. These types of crashes involving large passenger vans of church groups and students are more common than you would think.&lt;br /&gt;&lt;br /&gt;It is very common to see 15 passenger vans such as the Ford F-350 and others traveling on the nation’s highways and interstates carrying our most precious cargo – children. These vehicles most commonly transport baseball (or other sports) teams, church groups, day care students, boy/girl scouts and other similar groups. In fact, these types of vans are used by many private schools as the primary mode of transporting students on field trips or to extra-curricular events as they are much less expensive than actual school busses.&lt;br /&gt;&lt;br /&gt;And little is thought about it by the parents or the adults in charge.&lt;br /&gt;&lt;br /&gt;These vehicles do little to ensure the safety of its occupants. In fact they are among the most dangerous vehicles on the road. Specifically, the roll-over rate is extremely high in these types of vehicles. The &lt;a href="http://www.ntsb.gov/alerts/SA_001.pdf"&gt;National Transportation Safety Board (NTSB)&lt;/a&gt; calculates that the vans overturn more than half the time they are involved in single-vehicle crashes. Additionally, more than half of the occupants of these vehicles are killed or receive incapacitating injuries.&lt;br /&gt;&lt;br /&gt;The majority of the single-vehicle crashes involve tire safety issues. Additionally these types of vans are more likely to roll over with more passengers inside. This is largely due to the way the seats are positioned in the vehicle causing a high center of gravity.&lt;br /&gt;&lt;br /&gt;&lt;p align="center"&gt;&lt;a href="http://4.bp.blogspot.com/_zNnLzk5oKDA/TFsOFEiufxI/AAAAAAAAACY/bT3NeTQQeGU/s1600/van+chart.gif"&gt;&lt;img style="WIDTH: 313px; HEIGHT: 229px; CURSOR: hand" id="BLOGGER_PHOTO_ID_5502006850044722962" border="0" alt="" src="http://4.bp.blogspot.com/_zNnLzk5oKDA/TFsOFEiufxI/AAAAAAAAACY/bT3NeTQQeGU/s200/van+chart.gif" /&gt;&lt;/a&gt;&lt;/p&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The technology exists for other designs and features that would make these vehicles safer for passengers. Yet, the makers of these vehicles did not think these safety features were necessary – especially in the earlier models of these vehicles.&lt;br /&gt;&lt;br /&gt;Please think long and hard before you allow your child to ride in one of these 15 passenger vans. Consumer Reports has rated three models of baby strollers as “Don’t Buy: Safety Risk” – those strollers are:&lt;br /&gt;&lt;br /&gt;- Valco Baby Tri-Mode&lt;br /&gt;- Tike Tech City X3 all-terrain stroller&lt;br /&gt;- Tike Tech X3 Port jogging stroller&lt;br /&gt;&lt;br /&gt;These strollers received this rating due to the hazard of an unrestrained child slipping beneath the grab bar and getting stuck resulting in potential injury or death. (This is referred to as “submarining.”) Although the &lt;a href="http://www.cpsc.gov/"&gt;Consumer Products Safety Commission &lt;/a&gt;does not specify the particular strollers involved, they do report that there have been at least 10 infant deaths associated with submarining between 1995 and 2008.&lt;br /&gt;&lt;br /&gt;Safety regulations require that if the space beneath the bar is large enough for a child’s body to pass through, it must also be large enough for the child’s head to pass through. There is no danger in wearing the jewelry; however, it can be very dangerous if the metal is ingested. This particular jewelry line, when exposed to a chemical similar to stomach acid, very easily released the toxic metal.&lt;br /&gt;&lt;br /&gt;Exposure to this chemical is especially hazardous to girls ages 6-11. The suction cups, which are smaller than the size of a penny, present an asphyxiation hazard. These defective toys can cause children to suffocate and suffer brain injuries and even death. The two children’s deaths were caused when the children placed the soft, pliable plastic toy dart in their mouths and breathed them into their airways.&lt;br /&gt;&lt;br /&gt;The dart guns were manufactured in China and sold exclusively by Family Dollar Stores. Family Dollar Stores began selling the toy in September 2005 and stopped selling it in January 2009. Oprah’s efforts against distracted driving have led to the designation of today, April 30, as &lt;a href="http://www.oprah.com/showinfo/National-No-Phone-Zone-Day"&gt;National No Phone Zone Day&lt;/a&gt;. This morning, Oprah, together with &lt;a href="http://en.wikipedia.org/wiki/Holly_Robinson_Peete"&gt;Holly Robinson Peete&lt;/a&gt;, recorded her show at the Ferst Center for the Arts at Georgia Tech in Atlanta on this very topic. When this show airs (check your local listings), it will feature expert discussion on the dangers of distracted driving.&lt;br /&gt;&lt;br /&gt;Just yesterday, both branches of the Georgia Legislature passed legislation restricting the use of cell phones while driving. These bills are expected to become law effective July 1, 2010, pending the signature of Gov. Sonny Perdue.&lt;br /&gt;&lt;br /&gt;The bills, &lt;a href="http://www.legis.ga.gov/legis/2009_10/fulltext/hb23.htm"&gt;HB 23&lt;/a&gt; and &lt;a href="http://www.legis.ga.gov/legis/2009_10/fulltext/sb360.htm"&gt;SB 360&lt;/a&gt; (also known as the “&lt;a href="http://www.mydeathspace.com/article/2010/01/31/Caleb_Sorohan_(18)_died_when_he_hit_another_car_head_on__while_texting"&gt;Caleb Sorohan Act&lt;/a&gt;”) provide that no person, regardless of age, may use a telecommunications device to read, write or send any text based communication while driving.  In addition, no drivers under age 18 or with a learner’s permit or Class D driver’s license may use any wireless telecommunications device for any purpose while operating a motor vehicle, including phone calls.&lt;br /&gt;&lt;br /&gt;Violation of these provisions may result in a fines of up to $150 (which may be doubled if a collision results), points on the driving record and suspension of the driver’s license.&lt;br /&gt;&lt;br /&gt;Prior to this law, in Georgia, the only prohibition was on school bus drivers – they are prohibited from using cellular phones while driving if passengers are present.&lt;br /&gt;&lt;br /&gt;I am sure we can all appreciate the efforts being made by the Georgia Legislature (as well as many of the other states who have passed similar legislation) to make our roads safer for everyone. However, it is not only the responsibility of our law makers to make the roads safer. Instruct your children and other teen drivers about safe driving practices, including but not limited to TWD. A 2006 Harvard study found that 97 percent of claims were meritorious, stating, "portraits of a malpractice system that is stricken with frivolous litigation are overblown."&lt;br /&gt;&lt;strong&gt;Myth #2:&lt;/strong&gt; Malpractice claims drive up health care costs.&lt;br /&gt;&lt;strong&gt;Fact:&lt;/strong&gt; According to the National Association of Insurance Commissioners, the total spent defending claims and compensating victims of medical negligence was just 0.3% of health care costs, and the Congressional Budget Office and Government Accountability Office have made similar findings.&lt;br /&gt;&lt;strong&gt;Myth #3:&lt;/strong&gt; Doctors are fleeing.&lt;br /&gt;&lt;strong&gt;Fact:&lt;/strong&gt; Then where are they going? According to the American Medical Association's own data, the number of practicing physicians in the United States has been growing steadily for decades. Not only are there more doctors, but the number of doctors is increasing faster than population growth. Despite the cries of physicians fleeing multiple states, the number of physicians increased in every state, and only four states saw growth slower than population growth; these four states all have medical malpractice caps.&lt;br /&gt;&lt;strong&gt;Myth #4:&lt;/strong&gt; Malpractice claims drive up doctors' premiums.&lt;br /&gt;&lt;strong&gt;Fact:&lt;/strong&gt; Empirical research has found that there is little correlation between malpractice payouts and malpractice premiums paid by doctors. A study of the leading medical malpractice insurance companies' financial statements by former Missouri Insurance Commissioner Jay Angoff found that these insurers artificially raised doctors' premiums and misled the public about the nature of medical negligence claims. This does not happen. While insurers do pay out less money when damages awards are capped, they do not pass the savings along to doctors by lowering premiums. Currently, O.C.G.A. § 51-13-1 (commonly referred to as SB3) limits the non-economic damages (also known as pain and suffering damages) in a medical malpractice case to $350,000. The relevant portion of SB3 reads as follows:&lt;br /&gt;&lt;br /&gt;"In any verdict returned or judgment entered in a medical malpractice action, including an action for wrongful death, against one or more health care providers, the total amount recoverable by a claimant for noneconomic damages in such action shall be limited to an amount not to exceed $350,000.00, regardless of the number of defendant health care providers against whom the claim is asserted or the number of separate causes of action on which the claim is based."&lt;br /&gt;&lt;br /&gt;This means that no matter how severe an individual's pain and suffering is or how much a jury awards to a plaintiff for their pain and suffering, the plaintiff will only be allowed to collect $350,000.&lt;br /&gt;&lt;br /&gt;But what is pain and suffering worth? What is the pain and suffering worth that Mrs. Nestlehutt endured when her plastic surgeon so severly damaged the skin on her face that her face literally fell off? The jury in her case said it was worth $900,000.&lt;br /&gt;&lt;br /&gt;The case is Nestlehutt v. Atlanta Oculoplastic Surgery, P.C., d/b/a Oculus and was filed in 2007. The trial court judge, Judge Diane Bessen, ruled that the cap on non-economic damages violates the Constitution on 3 grounds: the right to trial by jury, the separation of powers doctrine, and the equal protection of the laws. Judge Bessen wrote:&lt;br /&gt;&lt;br /&gt;"A limit or cap on noneconomic damages, however, invades the right to a jury trial by usurping one of the fact-finding responsibilities of the jury. If the amount of noneconomic damages awarded by the jury exceeds the statutory cap, this Code section automatically and arbitrarily reduces the verdict, without consideration of the evidence, the record, or any other fact produced at trial and found by the jury. The limitations imposed by O.C.G.A. 51-13-1 render the right of the jury to assess damages meaningless… The cap so interferes with the determination of the jury that it renders the right of a jury trial wholly unavailable."&lt;br /&gt;&lt;br /&gt;The question the Georgia Supreme Court faces is this: is it proper for the Georgia Legislature to make a law that takes away our firmly entrenched right to a jury in order to keep more money in the pockets of doctors and insurance companies?  The news media goes to great lengths to spin tort reform as a way to reduce healthcare costs. But the numbers don't support their claims. Is a 2% reduction in medical spending really worth taking away the rights of patients? Our hope is that the Georgia Supreme Court will curb this legislation that protects only doctors at the expense of those they hurt the most.
